Estate Planning Review and Update Questionnaire

Please take 5 minutes to complete this questionnaire so that you may get the most from our time together when we meet to review your estate plan. For couples, the questions apply to each of you.
Your Name(s):

I. Trust Funding

1) Are there any bank accounts, C.D.'s, investment accounts, stocks, dividend reinvestment accounts, bonds, mutual funds, etc. not in your Trust's name? (Other than IRA’s, retirement accounts, and annuities)
2) Is any of your real estate not in the Trust name? If so, please bring the latest deed with you to our Trust Review Meeting. Note, you can skip this if we have recorded a Transfer on Death Designation Affidavit for your property
Have you rolled over or opened new IRA's, Qualified Retirement Plans, or non-qualified retirement plans since we last worked with you? If yes, please bring a recent copy of your account statement to our meeting.

II. Have there been any changes in your life?

4) What events have occurred in your life since you signed your trust or last updated it?
5) Are there any other significance changes in your life or your family members since the creation of your trust or your last trust amendment?

III. Are You Still Comfortable With Your Trustee and Agent Appointments?

6) Are you still satisfied with your selection of successor Trustees?
7) If you have minor children, do you wish to change the persons you named as guardians for them?
8) Are you still comfortable with the persons you named as property power of attorney agents?
9) Are you still happy with the persons you appointed to make health care choices for you if you are incapacitated? Or under your Living Will?
10) Have you made a HIPAA Authorization for Release of Protected Health Information prepared by Zimmer Law Firm?
11) Are you still happy with the distribution plan under your trust?

IV. Do any of the following apply to you?

12) I am concerned about how I can become eligible for Medicaid assistance with long-term nursing care either in my home or a facility, if I (or my spouse) become incapacitated., without having to spend my estate first
13) I want to add, delete, or change specific gifts to persons or charity under my trust
14) I would like to learn about protecting the inheritance I leave for my heirs from their legal predators, lawsuits, divorce, mismanagement, or undue influence.
15) I am concerned about how some of my heirs may handle money they would inherit and want to find out how I can protect their inheritance for good uses.
16) I have made loans to family members that I’d like to cancel at death.
17) I have made gifts to some of my heirs but not all of them, and I want to change my Trust to account for this.
18) My/our estate is now worth more than $11.7 million. (Don't forget to count everything when you make this calculation.)
19) I am concerned about protecting myself from legal predators such as lawsuits; legal claims, long term care costs or Medicaid spend--down rules.
20) Is there anything else you would like to share with us, information you need, or a matter with which you need assistance?
